These Terms of Service for the game "Destiny Sphere" (Destiny Sphere), hereinafter referred to as the "Terms", are simultaneously a service provision agreement on the part of the firm DestinySphere GmbH, hereinafter referred to as the "Administration", to the user of the game service "Destiny Sphere" (Destiny Sphere), hereinafter referred to as the "User". The Terms of Service for the game are mandatory for reading and approval by each user of the service before their actual registration on the website DestinySpher.ru.. User registration means their automatic approval of all points of the "Terms", therefore we strongly urge you to actually familiarize yourself with this text before registering.
If you do not agree with the "Terms" or any of its points, you have the right to refuse to use the game and its services. These "Terms" come into force for you from the moment you submit the completed electronic registration form.

1. General Provisions.

1.1 Destiny Sphere is a free strategy game that is entirely based on the internet and in which a large number of users can play simultaneously.
1.2 By entering the game, you become a member of a large gaming community. Any action you take from this moment on will, in a certain way, affect the events in the entire game world, including the atmosphere prevailing in the gaming community, and the enjoyment that other users derive from the service offered. Therefore, the Administration has the right to demand that members of the gaming community comply with the above "Terms".
1.3 In case the Administration discovers a violation of these "Terms" by the User, the Administration has the right to deny them further use of the service and remove materials published by such a User from the information systems Destiny Sphere.
1.4 To use the service, the User only needs to register their membership in the game once. A single registration is valid for both the Game Space and the Forum and Portal.
1.5 The Administration reminds you that each user pays for their own internet access.
1.6 Minors must obtain permission from parents or guardians to use the service.

2. User Obligations, Rights, and Restrictions

2.1 User Rights
2.1.1 Within the provided technical capabilities, the User has the right to view and modify their personal data.
2.1.2 The User has the right to change their registration password.
2.1.3 The User can terminate their membership in the gaming community at any time. To do this, they need to send an email to the contact email "Destiny Sphere".
2.1.4 The User, at their own personal responsibility, has the right to post any information on the service's information systems within the scope of the service's technical capabilities. The Administration is not responsible for the content and security of such information.
2.1.5 Use of the service is possible at any time and in any technically suitable place.
2.1.6 User personal data, including their IP-address and unique computer number, cannot be transferred to third parties. Exceptions may be made only by court order or prosecutor's request. The User grants the Administration permission to store personal data, including their IP-address and unique computer number, and to process it for statistical analysis purposes. All statistical analysis results are anonymous.
2.1.7 By registering their account in the game, the User agrees to receive newsletter updates DestinySphere.
2.2 User Obligations and Restrictions
2.2.1 The User is obliged to provide truthful information about themselves.
2.2.2 The User is obliged to keep secret the password chosen during registration. The User bears personal responsibility for any possible manipulation of the password caused by negligence in keeping it secret or disregard for information security standards when using computer networks. Your password data is stored in the service's database only in encrypted form. If you forget your password, then upon your request, the service's software resources will automatically send an open email with a new access password to your email address. Remember - such a procedure is always associated with the risk that your password may become known to an attacker who has gained control of your computer or mailbox. The Administration cannot remind you of your forgotten password.
2.2.3 Each User has the right to register in one game world, receiving one basic comb under their control. Control of multiple combs by one User, achieved by transferring a comb from another player or by re-registration, is strictly prohibited. Such multi-users, if detected, will be excluded by the Administration from the gaming community, their basic combs will be destroyed, and they will be deprived of the right to further participation in the game.
2.2.4 The User does not have the right to transfer control of their basic comb to another person. A User who transfers control of their basic comb also risks being removed by the Administration from the game and communication space.
2.2.5 The User must, as far as possible, regularly use the game component of the service. In case of User inactivity for more than four weeks or in case the user has 0 points for more than three days, the Administration has the right to resettle their basic comb with another user without warning. Such a "evicted" User, if they wish to return to the game, will have to start all over again; only their game name will be preserved.
2.2.6 The User does not have the right to post materials on the service's information resources that openly contradict public morality and ethics, personally insult other community players, moderators, or the Administration, or contribute to inciting interethnic or international discord. The use of profanity is not permitted in any form. If materials are found to be published in violation of clause 2.2.6 of the "Terms", the materials may be deleted, and the User who made such publications may be warned, or, in serious or repeated cases, excluded by the Administration from the gaming community, their basic comb destroyed, and they will be deprived of the right to further participation in the game.
2.2.7 The User does not have the right to post on the information environment of "DestinySphere" themselves, or to provide links on the Internet to any information whose distribution violates Russian or international law.
2.2.8 The User is prohibited from using the Service for commercial or political purposes.
2.2.9. The service user is prohibited from:
- selling/buying for real money,
- exchanging for items (services) that may represent material value, any virtual (game) resources, both within the provided DestinySphere GmbH service and through other internet resources.
2.2.10 The User does not have the right to post on the information environment of "DestinySphere" themselves, or to provide links on the Internet to any information or software that contains viruses or other harmful components.
2.2.11 No part of the Service may be copied, reproduced, or translated into other languages without the Administration's permission.
2.2.12 The use of software, other materials, and any information of the Service for commercial purposes is prohibited unless there is written consent from the Administration for such actions.
2.2.13 Unauthorized (unauthorized) intrusion into any technological components (nodes), programs, databases, and other constituent elements of the Service network is prohibited, as well as any actions, the commission or attempted commission of which is punishable under Russian law for such acts as: Chapter 21 of the Criminal Code of the Russian Federation "Crimes against property" Article 159 "Fraud"; Chapter 28 of the Criminal Code of the Russian Federation "Crimes in the sphere of computer information": Article 272 "Unlawful access to computer information", Article 273 "Creation, use, and distribution of malicious programs for computers", Article 274 "Violation of the rules of operation of computers, computer systems, or their networks".
2.2.14 Users are prohibited from using discovered errors (bugs) in the game software for their own purposes. In case of discovering such an error, the User is obliged to inform the Administration about the existence of such an error by posting a message in the relevant forum section, by email to the Administration's contact address, or by sending an internal private message to the moderator responsible for the relevant forum section.

3. Administration Rights and Responsibilities.

3.1 The Administration undertakes the obligation, to the extent of its technical capabilities, to regularly monitor user information messages for compliance with the game "Terms", the Laws of the Russian Federation, and international law. The Administration, however, bears no responsibility for the content of materials published by Users and does not guarantee 100% effectiveness of such monitoring.
3.2 The game "Destiny Sphere" is constantly evolving. The dynamic development of the game implies the possibility of errors that may lead to temporary malfunctions. The Administration strives to provide Users with the maximum possible temporary accessibility of the service and stability of its operation, high-quality and dynamic development of the game's software resources, and the maximum possible speed and quality of support (answers to player questions).
3.3 The Administration bears no responsibility for service interruptions, the quality of support and the service as a whole, for the security of User information materials, their basic combs, and virtual game resources.
3.4 The Administration also provides no guarantees that the software or any other materials obtained through the Service are free of viruses and other harmful components.
3.5 The Administration is not responsible for any damage caused to the User as a result of using the service.
3.6 The Administration is not responsible for any damage caused to the User as a result of using the service for purposes other than those for which this service was provided.
3.7 The Administration is not responsible for direct or indirect damage caused to the User as a result of using or inability to use the Service, or caused by reliance on information, services, or goods supplied by or through the Service, as well as damage arising from errors, omissions, interruptions, file deletion, defects, delays in operation or data transmission.
3.8 Denial or termination of access to the Service may be caused by the following circumstances:
- threat to the security and defense of the state, health and safety of people;
- in case of physical, topographical, and other natural obstacles;
- the User is involved in actions that the Administration, solely from its point of view, considers a violation of these "Terms". In this case, the Administration is not responsible for notifying the User or any third parties about the User's access deprivation and for possible consequences arising from the absence of such a warning.
- if the User does not agree with these terms of Service provision;
- the User refused to provide their data during registration or provided knowingly false information about themselves.
- the User uses the Service for any purposes contrary to the laws of the Russian Federation or international law.
- the User violates the rules and laws on which the provided Service is based.
- upon past violation of these "Terms" by the User.
- upon cessation of operation of any communication means of the Service.
- due to force majeure circumstances (war, civil unrest, epidemics, natural disasters, etc.)
- due to the closure or suspension of the service
3.9 No part of the software can be copied, reproduced, translated into other languages, etc., without prior written permission from the Administration.
3.10 No information or advice given by the Administration or its representatives can be considered as a guarantee of "ultimate truth". The Administration is not responsible for the results of the User following the advice and consultations provided to them.
3.11 The Administration is not obliged to monitor the content of information distributed through the Service.
3.12 The Administration reserves the right to remove any information or materials from its servers, in whole or in part, if, solely from the Administration's point of view, they are unacceptable, undesirable, or violate these "Terms".
3.13 The Administration expressly disclaims any warranties and/or conditions, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
3.14 The Administration provides no obligations.
3.15 The Administration does not guarantee that the software, texts, graphics, and music contained therein will meet the User's requests, requirements, or expectations.
3.16 The Administration is not responsible for any third-party claims.
3.17 The Administration may change the quality of the Service at any time without prior notice to the User.
3.18 When using the Service, the User agrees that through the Service they can use both the Service itself and its components, as well as the global Internet. By these "Terms", the User is notified and agrees that, in addition to information, products, or services explicitly stated as provided by the Service, the Administration does not control information, services, and products located on (or offered through) the Internet. The User assumes full responsibility and risks for using the Service on the Internet and accepts the fact that the Administration bears no responsibility for the accuracy and quality of information published by service Users, in advertisements, or in the content of web pages linked to the Service. Consequently, the User agrees that all goods, information, and services offered or available through the Service or on the Internet (except for those explicitly stated as provided directly by the Service) are provided by third parties who are not affiliated with the Administration. The User assumes full responsibility and risks for using the Service and the Internet. The User agrees that they are solely responsible for evaluating the accuracy, completeness, and usefulness of all opinions, assessments, services, and other information, the quality and functions of goods provided through the Service or the Internet in general.
3.19 The Administration does not support and is not responsible for any possible actions of third parties or organizations in creating paid services thematically related to the game, as well as for the sale of any virtual resources in the game.

4. Amendments to these Terms.

4.1 The Administration reserves the right to change these "Terms". Users will be informed of such changes through the game's information resources. A User who expresses disagreement with the changes to the "Terms" has the right to refuse to use the game and its services. Continued membership in the game world Destiny Sphere means automatic approval of the changes made to these "Terms" by the User. The User is obliged to regularly check these "Terms" for possible changes.
4.2 The recognition of one or more points of these "Terms" as contradicting the norms of Russian or international law does not affect the validity of the remaining points of the "Terms" or the document as a whole. The absence of strict enforcement of any provision of this Agreement by the Administration shall not be considered a waiver of the enforcement of that provision. Neither the established practice of behavior of the parties nor the practice of providing similar services can be used as leading to a change in any of the provisions of this Agreement.

Addendum to the terms of service provided by DestinySphere GmbH.

• A user is not allowed to register in any game world if they already have a base comb in another world. To gain the ability to register in any game world, which costs 1000 rubles, they can pay for this opportunity using the paid services form.

• The user also undertakes to adhere to the following rules:
Rules of playing in Destiny Sphere from internet cafes, gaming clubs, as well as other networks using the same IP address, and when using two or more accounts on one computer.
Forbidden:
1. Resources.
a) Transfer - gratuitous transfer of a resource from one comb to another.
b) Buying something from one comb for the intended transfer amount.
c) It is forbidden to conduct any trading transactions with another account on the same computer.
2. Army.
a) Giving an army for use to another comb.
b) Selling an army for resources.
c) Exchanging units.
d) Any trading of units between you is forbidden.
3. Artifacts.
a) Selling/Buying artifacts from comb to comb.
b) Exchanging artifacts.
4. Alliance.
When joining an alliance, you need to pay attention to being in different alliances. Being in the same one is highly undesirable.
5. War.
It is forbidden to attack a single target with combined efforts, meaning your armies should not intersect in the same place.

• Users are forbidden from creating other accounts on forums DestinySphere, besides their game account.

• Users are forbidden from using free/premium accounts provided by DestinySphere GmbH for mercenary purposes, in other words - it is forbidden to sell/buy game resources/user accounts for any real-time monetary/in-game currency.

• Service users are forbidden from buying/selling/exchanging game resources between spheres (game worlds)

• Free account users are forbidden from viewing more than 50 complexes in the game world per day.

• Premium account users are forbidden from viewing more than 150 complexes in the game world per day.

• Users whose computers are used for playing on multiple accounts, for relatives/friends/colleagues, etc., must notify the administration,

• Users are forbidden from sending armies with obscene/profane/racist/extremist names to other users' combs.

• Users are forbidden from insulting other users in any way via in-game mail.

• A user temporarily and passively supporting another account (account-sitting) agrees to the following rules:

Sitting - Account Sitting (hereinafter referred to as sitting) - voluntary transfer of one's account by one player to another single player for a period of time, for care of it (the account). Accounts must be in the same Sphere. (Orion, Andromeda, Perseus, etc.)

Sitting is allowed:
1) Provided that the player has sent an email to sitting@destinysphere.com with the exact coordinates of their comb and colonies, the coordinates of the sat-in comb and colonies, the account logins, and the start date of the sitting.
2) Provided that the sitting lasts no more than one month. After a month from the start of the sitting, the player is forbidden from logging into the account. The account will be valid for ANOTHER month from the end of the sitting, after which it will be deleted if the account owner does not return.
3) Provided that the player is sitting for ONLY one account, not including their own. Managing two or more accounts is forbidden and is equated to multi-accounting.
4) The player must be prepared to provide a report of their actions on the sat-in account to the inspector appointed by the administration. It is forbidden to use the sat-in account for personal gain.
5) Provided that the account originally belongs to another individual.

During sitting, the following is allowed and forbidden:
1) Development operations of combs are allowed, such as: sending archaeologists, studying sciences, constructing buildings, constructing units, founding colonies, transferring resources through the Colonization Center, minimal trading to maintain active comb balance.
2) Any trading operations are strictly forbidden.
3) ALL military actions on the sat-in account are strictly forbidden. Be it active defense, attacks, etc.

Violation or non-compliance with any of the above points automatically classifies the sitting as multi-accounting and is submitted for review by the Disciplinary Department.

• In case of server problems and the appearance of a special counter for logging into the game, users are forbidden from using any known methods to bypass this counter.

• Users are forbidden from sending their armies to banned players if information about the player being banned has become publicly available.

Addendum from 06.06.06 (ominous) The administration has the right to roll back any battle or other game event in the game world Destiny Sphere if the result of this event was achieved in violation of the above rules.
